Meeting opened by Chairman James Joyce at 7:05.

Old Business:

Minutes of meetings of 7/17/2006, 8/21/2006 and 9/05/2006 were amended and approved as amended.

New Business:

Applicant Charlene Kennedy
Location  - 45 Ona Road, Map 101, lots 61, 62, 63, 64 and 65
Description:
Applicant previously applied for a Variance to subdivide two lots from her five contiguous lots, the total acreage of the five lots being less than the required two acres, such lots must be considered as one combined lot according to Massachusetts Zoning Regulations.

Variance was deniedApplicant is re-applying, but wants to create only one new lot, which would still violate Massachusetts Zoning Regulations.  

Action Taken:  Application was rejected.  ZBA will hear the case September 27th.

Applicant – Leonard and Susan Tillman
Location – 93 Chipmunk Crossing, Map 115, Lot 78.
Description: Site Plan for 8’ x 6’ bathroom to be added to side of house.
Action Taken - As all setbacks will be met, application approved by all members present.

Applicant – Mark De Celle and Sherry Lavoini, P.O. Box 1329 East Otis, MA 01029
Location – 84 Moreau Road, Map 102, Lot 12 & 19 (Contiguous lots treated as one).
Description:
Applicant wants to establish an apartment in his existing barn

The property is a pre-existing non conforming lot of less than two acres

Tolland’s Zoning Bylaw requires a minimum of two acres for the granting of a Special Permit for an accessory apartment.

Action Taken – Application held over to allow time to consult with Town Attorney.

Meeting to be scheduled with Town Attorney: James Joyce will try to schedule a meeting with our Town Attorney, the Planning Board and the Zoning Board of Appeals to explain some problem points.

Check List discussion  deferred: A scheduled discussion of “check lists” will be held over until our next meeting.

Next Meeting: The next meeting of the Planning Board is scheduled for October 16th, at 7:00 p.m.
